This agreement constitutes a legally binding contract between

Susan Seale       and     purchaser/participant of the services, programs, products, courses and/or private sessions.

TERMS OF USE

Susan Seale also referred to as “I”,  “my” or ”me" in this agreement.

The purchaser/participant also referred to as “you” or “your” in this agreement.

When purchasing my Programs, Products or Materials you agree to these Terms of Use and are legally bound by them, whether or not you have read them.

If at any time you do not agree with these Terms of Use, please do not use my Programs, Products or Program Materials.

You must be at least eighteen years of age to use my website. Use of this website is at your own risk.  I host my site on a reputable platform and take reasonable efforts to maintain and host the site. However, I make no explicit representations or warranties as to the safety of your individual use of the website. The Terms and Conditions contained on this page are subject to change at any time.

Fees and Payments

Program fees are payable through the registration form provided in the payment cart.

Receipt

Receipt of all paid fees will be provided.

Refunds 

Full refunds available up until the first rehearsal.  

After the semester begins, pro-rated refunds are available until end of third rehearsal.  No refunds available after the third rehearsal.

COACHING SERVICES

Refunds 

Refunds are NOT available for physical or digital products, programs, courses or services, even if you miss sessions or decide not to continue with the program at any time, for any reason during the program.

You are responsible to complete your monthly payments (if on a payment plan) even if you miss sessions or decide not to continue with the program at any time, for any reason.

Susan reserves the rights to terminate the contract at any time without explanation.  If Susan cancels, refunds will be calculated on a pro-rated basis.

Chargebacks

You agree to never dispute any charges already paid, no matter the payment vehicle. (Example: Paypal, Stripe, bank transfer, etc.)

Late payments

In the case of monthly payments, if payments are not received as promised, Susan reserves the right to pause our work together until late payments have been received.  

Recorded Sessions

Sessions may be recorded and made available to each participant.

Social Media Groups

You understand that social media groups provided as part of this program are organized on public social media platforms not owned by me, and even if the group is private, your privacy is not guaranteed.

Confidentiality

You agree that submitting confidential information is done at your own risk.

There are digital apps, platforms and services required to manage the digital nature of my online business and due to the nature of the internet, I cannot completely ensure the security of your information even though I do everything I can to protect your information.  

Any communications made through my ‘contact’, blog, blog comments, newsletter sign up, or other related pages, or directly to my phones or mailing or email addresses is not held privileged or confidential and is subject to viewing and distribution by third parties. 

I own any and all communications displayed on my website, servers, comments, emails, or other media as allowed by my jurisdiction’s laws, and will not give credit or pay royalties for unsolicited user-generated content such as blog comments or emails. For more information on when and how I store and use your communications or any data provided by you in those communications, please refer to Privacy Policy.

I maintain a right to republish any submission in whole or in part as reasonably necessary in the course of my business. You agree not to submit any content or communications that could be illegal or serve an unlawful purpose, including, but not limited to communications that are potentially libelous or maliciously false, obscene, abusive, negligent, or otherwise harmful or inappropriate.

Your Responsibility

You agree you are solely responsible for your results and will take 100% responsibility for your life and business and financial decisions while participating in any program, course, service or private session.

You agree that Susan Seale is not responsible for your earnings, the success or failure of your business decisions, the increase or decrease of your finances or income level, or any other result or adverse outcome of any kind that you may have as a result of your participation in the program.  

You understand that you are encouraged to hire and make use of your own financial advisors, legal advisors and accountants.

Respect

You agree not to copy, create a derivative or represent my Programs, Products or Materials as if they are yours or created by you.  

You agree to consult with me if you wish to use my work by obtaining written permission and credit me where I should obviously be credited.

You may NOT use my intellectual property in any way, which includes republishing any text, image, design, or other property on another website, or posting a quote or image from my site to any third-party website including social media. I have spent a great deal of time and money building the intellectual property located on this site and in order to maintain the integrity of it, I cannot allow any third party use.

Indemnification

​​​You ​​agree​​ at ​​all​​ times​​ to​​ indemnify​​ and ​​hold​​ harmless​​ my​  company, ​​as well​ ​as​ ​any​ ​of​ ​my​ ​affiliates,​ ​agents,​ ​contractors,​ ​officers,​ ​directors,​ ​shareholders, employees,​ ​joint​ ​venture​ ​partners,​ ​successors,​ ​transferees,​ ​assignees,​ ​and​ ​licensees,​ ​as applicable,​ ​from​ ​and​ ​against​ ​any​ ​and​ ​all​ ​claims,​ ​causes​ ​of​ ​action,​ ​damages,​ ​liabilities, costs​, ​and​ ​expenses,​ ​including​ ​legal​ ​fees​ ​and​ ​expenses,​ ​arising​ ​out​ ​of​ ​or​ ​related​ ​to​ ​my offering(s)​ .

Limitation of Liability

​​​I​ ​will​ ​not​ ​be​ ​held​ ​responsible​ ​or​ ​liable​ ​in​ ​any​ ​way​ ​for​ ​the information,​ ​products,​ ​or​ ​materials​ ​that​ ​you​ ​request​ ​or​ ​receive​ ​through​ ​or​ ​in​ ​relation​ ​to​ ​my offering(s).​ I​ ​do​ ​not​ ​assume​ ​liability​ ​for​ ​any​ ​third​ ​party​ ​conduct,​ ​accidents,​ ​delays,​ ​harm, or​ ​other​ ​detrimental​ ​or​ ​negative​ ​outcomes​ ​as​ ​a​ ​result​ ​of​ ​your​ ​access​ ​of​ my offerings or related materials.

Termination

If at any time I feel you have violated these Terms and Conditions, then I shall immediately terminate your use of my website and any related communications as I deem appropriate. It is within my sole discretion to allow any user’s access of my website, and I may revoke this access at any time without notice, and if necessary, block Your IP address from further visits to my site(s).

Non-disparagement

​If you are found to be slandering, libelling, or otherwise disparaging my company, offering(s), or related materials at my discretion, you will be immediately removed from the offering(s) and any related communications. I reserve the right to file a civil claim of action against you for any such damaging actions you take that materially harm my company.

My Responsibility

As your personal soul coach, I provide intuitively guided sessions and strategically planned sessions to support you in reaching your goals.

Client Responsibility

You, as the client, agree to actively take part in your own success and healing!

Soul Coaching work may elicit past memory, unearth experiences that cause tears to flow, and may enter into emotional and spiritual ground that feels vulnerable.  This may require increased attention to your self care needs.  As the client, you agree to practice self care throughout the term of our soul coaching and feng shui programs

Susan Seale is not a therapist, clergy, counsellor or medical professional, and as such, she does not treat, medicate or diagnose medical or mental health conditions.  If you require those supports, you agree to seek out those professionals as needed.
